  • Q. I was in an accident that wasn’t my fault. Can my insurance company raise my rates?

    A. An insurance company cannot raise your rates if you were involved in an accident that was not your fault.

  • Q. I was hit by a drunk driver, am I entitled to damages other than compensatory?

    A. You may be entitled to punitive damages in addition to compensatory damages if you were hit by a drunk driver to punish his or her conduct.

  • Q. I was involved in an accident that was partly my fault. Can I still recover anything?

    A. Even if you were partly at fault for causing an accident, you still may be able to make a partial recovery from the other party.

  • Q. I was in an accident that wasn’t my fault. Can I recover any lost income?

    A. You may recover for any lost income due to an accident which was not your fault.

  • Q. The person that hit me has a small liability policy. Can I recover anything else?

    A. If you have uninsured motorist coverage larger than his liability policy, or if you have more than one car with uninsured motorist coverage you can recover the total amount of your uninsured motorist coverage less the amount of his liability policy. This will not raise your insurance rates.

  • Q. I was injured while on the job by someone other than a co-worker. Can I recover anything other than workers compensation benefits?

    A. You can recover against the at fault person's insurance company in addition to the workers compensation benefits you receive.

  • Q. I was struck by a car while walking across the street. The car had no insurance. Can I still recover?

    A. You can recover from your own uninsured motorist coverage even though you were not in your car.

  • Q. I don't have health insurance and can't afford to get medical treatment for the injuries I suffered in an accident. Is there anything I can do?

    A. Many health care professionals take a "Letter of Protection" from an attorney which guarantees they will get paid out of your settlement. That way they will treat you without your having to pay until your case is settled.
